Merkel risks rebellion on euro rescue fund (Reuters)

BERLIN/ATHENS (Reuters) ? German Chancellor Angela Merkel may fall short of a majority in her own coalition for a crucial reform of the euro zone rescue fund meant to stop a sovereign debt crisis spreading, in what would be a severe blow to her authority, a test vote showed.

Talk of proposals to leverage up the 440 billion euro ($598.5 billion) bailout fund to multiply Europe's financial firepower lifted global stocks on Tuesday but made it harder for Merkel to unite her fractious center-right coalition.

The Bundestag (lower house) is sure to approve a widening of the scope of the European Financial Stability Facility to aid weak states and banks, agreed by European leaders in July, since the opposition Social Democrats and Greens say they will vote for the measure on Thursday.

But a revolt by Euro skeptical backbenchers hostile to further bailouts in Merkel's conservatives and their liberal Free Democratic coalition partners may leave her without a majority in her own camp.

In an internal vote on Tuesday, 11 deputies from Merkel's CDU/CSU group voted against the motion and two abstained. Coalition sources said they expected between 2 and 5 FDP lawmakers to vote against and up to 6 to abstain.

If more than 19 coalition lawmakers vote against or abstain, Merkel will be dependent on opposition votes in a political humiliation that could weaken her ability to push through future rescues.

European shares surged by 4.3 percent in the biggest one-day percentage gain since May 2010 and safe-haven German bonds fell on reports that policymakers were preparing decisive action to tackle the debt crisis.

The cost of insuring Italian, Spanish and French debt against default also fell on hopes of a bold solution, which appear to have little grounding in immediate political reality.

German Finance Minister Wolfgang Schaeuble was forced to deny that any increase in the volume of the bailout fund is planned in a bid to calm irate center-right lawmakers.

"We do not intend to increase it," Schaeuble told n-tv.

That did not directly address the question of whether the EFSF fund could be leveraged to raise more money to prevent contagion spreading from Greece to Italy and Spain, the euro zone's third and fourth economies.

LIABILITY

Leverage would make it possible to borrow more, probably from the European Central Bank, for financial firefighting without increasing the EFSF's size, but critics say it would also raise German taxpayers' liability for any losses.

Some lawmakers are concerned that EU officials are just waiting for them to approve what they were assured would be the final increase before pressing ahead with bigger bailout plans.

French Finance Minister Francois Baroin made clear there were tactical reasons to avoid discussing how to boost the fund's firepower before the German decision.

"It is out of the question to put forward, three days from the Bundestag (lower house) vote, the issue of whether we should increase the fund... Let's not open Pandora's box on something that is a red flag for Germany," he said.

Prime Minister Francois Fillon told parliament France would set out proposals to step up the battle against "speculative attacks" on the euro zone once the German vote was over.

The fund's status was bound to evolve but it was premature to say whether it might work "like an equity fund with a lever effect," Baroin added.

Merkel assured Greek Prime Minister George Papandreou at a meeting on Tuesday evening in Berlin that Germany wants a strong Greece and would do everything necessary for that. She also said she was confident her coalition would have the votes on its own to pass measures boosting the euro zone rescue fund.

Papandreou told Merkel that Greece needed Europe's solidarity. "It is very important to receive a signal of support from our European partners," he said.

Earlier, Papandreou had promised German industrialists that Greece would meet its commitments under its EU/IMF bailout program despite missing key fiscal targets so far.

"I can guarantee that Greece will live up to all its commitments," Papandreou said.

Merkel told the same forum: "We will provide all the help desired from the German side so that Greece regains trust." However, some of her ministers have openly questioned the country's ability to avoid default and stay in the euro zone.

DAMAGE

The Greek parliament approved a deeply unpopular new property tax on Tuesday, one of several extra austerity measures the government is rushing through to plug a budget hole uncovered by EU/IMF inspectors earlier this month.

Greek Finance Minister Evangelos Venizelos, back from talks with the International Monetary Fund, said speculation on default scenarios was harming his country and it was crucial to stick to the July 21 agreement on a second rescue for Greece.

Venizelos said the so-called troika of senior EU/IMF inspectors would return to Athens this week and Greece would receive the next 8 billion euro instalment of aid in time to avoid bankruptcy next month. Most analysts expect Greece to get the cash but default anyway within a few months, perhaps early next year.

European Central Bank board member Lorenzo Bini Smaghi fueled expectations of a larger bailout pool by saying on Monday that policymakers were working on "how to leverage the money out of the EFSF in a more innovative and efficient way."

Citing U.S. programs to rescue banks during the 2008-9 financial crisis, he said EFSF funds could be used as collateral to borrow from the central bank, making more money available for crisis fighting. His ECB colleague Ewald Nowotny also said an increase in the funds available was being discussed, though it might not be as high as some expected.

But German Bundesbank chief Jens Weidmann, the leading hawk on the ECB's governing council, poured scorn on such options, saying they would discourage politicians from taking tough decisions to cut budget deficits and weaken faith in the euro.

The European Investment Bank, the 27-nation EU's soft-loan project finance arm, denied a U.S. television report that it might get involved in leveraged finance for euro zone bailouts, which diplomats said was legally impossible. [ID:nB5E7KL004]

Credit ratings agency Standard & Poor's was quick to warn when talk of leveraging the EFSF became public last week that such a move could potentially trigger ratings downgrades for leading euro zone countries Germany and France. [ID:nW1E7JU02F]

A senior EU official said many ideas for how to leverage the rescue fund were being floated but it would take time to check the legality of such options and build political consensus in the 17-nation euro zone for any change.

"Nobody wants to talk about this before Thursday night," he said in a reference to the German parliament vote. "It cannot be discussed formally before the Bundestag (lower house) and maybe all other national parliaments have voted."

Slovak lawmakers will be last to vote on the widening of the EFSF's powers on October 11, leaving little time to agree on further measures before the bloc's next summit on October 17-18.

In Bratislava on Tuesday, the junior government party rejected a proposal made by its larger partner aimed at winning joint coalition support in parliament for plans to strengthen the bailout fund.[ID:nL5E7KR2IR]

In his article entitled, ?Obama, Palestine and the Arabs,? published in Saturday?s issue of the Spanish daily El Pais, Javier Valenzuela described much of the world?s frustration and disappointment with President Obama over the events that transpired last week at the United Nations.

For the author, Obama revealed himself as ?just another politician.? This came as a great disappointment for many people worldwide who once believed the President?s calls about changing social injustice. In opposing the Palestinian application to join the United Nations, Obama acted as a sophist, one who reasons with clever but fallacious arguments. According to Valenzuela, Obama?s insistence that before the Palestinians can apply for international recognition as a state they must negotiate with Israel was an ?insult to universal intelligence? after twenty years of languishing talks.

Valenzuela referred to the various forms negotiations have taken, yet still have proven ineffective: ?Mediators, special envoys, quartets, summits, formulas, public and secret negotiations, direct and indirect talks.?

Meanwhile, not only has the occupation continued but so does the appropriation of land and construction of new settlements, in which there are now more than 500,000 Israeli settlers. The result is that checkpoints and settlements throughout East Jerusalem and the West Bank create a ?nightmare of labyrinths? for Palestinians that make it impossible to create a viable state. As for Gaza, according to the author, it has all been forgotten, which he compared to an outcast leper colony.

?Two can not dance if one does not want to, and the strategy of Israel is transparent and effective,? Valenzuela stated. According to the author Israel uses negotiations as a pretext to provide time to expand settlements and undermine any possible negotiated solution. It is a great irony to Valenzuela that the Israelis can claim that Abbas?s request for recognition of a Palestinian state at the UN is irrelevant, when the legitimacy of Israel was based on General Assembly Resolution 181 that partitioned British Mandated Palestine to establish their state.

Valenzuela noted that everyone realizes why Obama has opposed the Palestinian application; because of domestic political pressures, though, according to the author, the ?recipient of the Nobel Peace Prize? could have been more ?subtle? in revealing this. Referring to the US and Israeli argument that the Palestinian initiative is unilateral and counterproductive, Valenzuela cited the point made by a colleague writing in El Pais the day before. Abbas?s initiative going before the UN ?could not be more pacifist, legal and multilateral,? he stated.

The author noted how the Palestinians have offered to Israel as much as is possible, having lost 78% of their land in 1947 and 1948. In addition, the PLA has recognized Israel?s right to exist since 1988, and the Arab League in 2002 offered to do the same if a Palestinian state was established based on the pre-1967 borders.

President Obama?s speech last week at the UN, moreover, erased all of the ?positive effects? of his 2009 Cairo speech on the Arab world that included stating,? ?It is also undeniable that the Palestinian people have suffered in pursuit of a homeland. For more than sixty years they have endured the pain of dislocation. They endure the daily humiliations that come with occupation. The situation for the Palestinian people is intolerable.? Valenzuela noted that during his speech Wednesday, Obama could not even bring himself to repeat his previous assertions about freezing settlements or that the basis of a Palestinian state should be the 1967 borders.

Valenzuela even pointed out the irony that it was Obama himself who first had the idea that Palestine would become a new UN member state this September, when the US President stated this goal the year before at the General Assembly.

For the author there is no contradiction in accepting Palestinian membership to the UN and then working out the details on issues like borders, especially when twenty years of talks have not proved fruitful.

To conclude Valenzuela, noted that before Obama converted to ?just another politician? the President had ?dreamed that the United States would form a more balanced relationship with the Middle East.? After the past week, however, the relationship between the United States and Arab world had only grown further apart.

Could one music downloader change U.S. copyright law? (Reuters)

NEW YORK (Reuters) ? In the age of iTunes and an-app-for-everything, Joel Tenenbaum's battle with the music industry over illegal downloading seems as relevant as an eight-track cassette.

But it turns out the fight could produce something surprisingly enduring: a change in copyright law.

Back in 2007, Tenenbaum was one of 35,000 individuals sued by Recording Industry Association of America in a legal assault meant to discourage music lovers from illegally downloading songs. While the vast majority of rogue downloaders settled their cases, only Tenenbaum and one other defendant hung on for a trial.

Over the course of the litigation, Tenenbaum's testimony earned him some notoriety -- he blamed the downloading on burglars, a foster child and his sisters before finally confessing -- but the digital-rights community continued to support his case. A friend-of-the-court brief supporting Tenenbaum's constitutional arguments was co-authored by members of the Electronic Frontier Foundation, a lobbying group, as well as Stanford and Berkeley law school's clinics on technology and public policy. Harvard law professor Charles Nesson, founder of the school's Berkman Center for Internet & Society, took Tenenbaum on as a client and has been representing him pro bono since 2008.

Now, as Tenenbaum's case enters its next stage, those advocates see a renewed opportunity to push for an answer on how copyright laws should be enforced.

"The system is outdated," said Jason Schultz, an assistant clinical professor of law at Berkeley and the co-director of the Samuelson Law, Technology & Public Policy Clinic. While Tenenbaum is an imperfect - and unsympathetic defendant - he is a vehicle for bringing copyright law up to speed. "It's a real case and a real guy that's been run up for (real) money," said Schultz. A court will eventually make a decision on the issue of appropriate copyright damage, he said. "We're trying to help them make the right one."

$22,500 PER SONG

The stage was set two weeks ago when the First Circuit Court of Appeals reinstated a $675,000 judgment against Tenenbaum, or $22,500 for each of 30 charges of illegal downloading -- a reversal of a trial judge's decision to knock the award down to $67,500. The ruling was a blow to Tenenbaum, who had argued that that the Copyright Act was not meant to be applied to consumer copying and that the recording industry was not harmed. He argued that such a large amount for an individual was unconstitutional and unfair.

"I can't afford the $67,000 it was before. I sure as hell can't afford the bigger amount," Tenenbaum, who now is studying physics as a graduate student at Boston University, told Reuters. He said he will declare bankruptcy if the judgment is upheld.

The Copyright Act, last extensively revamped in 1976, allows plaintiffs to take two approaches to damages. They can either ask for the quantifiable amount of harm caused or seek statutory damages. Today, violators can be forced to pay between $750 and $150,000 per infringement.

The Recording Industry Association of America, and its members such as Warner Bros Records and Sony Music Entertainment, maintain that the current law is fair, offers jurors flexibility and provides the proper deterrent to would-be violators.

DIGITAL RIGHTS ADVOCATES

In the view of digital rights advocates, however, the law is wildly out of line with contemporary technology, where nearly every device allows users to make and upload copies of nearly anything.

In the Tenenbaum case, Schultz and others pushing for changes to electronic rights, were hoping the First Circuit would rule on whether or not the $22,500 per violation statutory damage award was unconstitutional. Courts should "ensure damages bear a reasonable relationship to actual harm" and provide guidance on how statutory damages will be imposed so creators can "adequately navigate the waters of copyright law," the Electronic Frontier Foundation argued in its friend-of-the-court brief.

The First Circuit, however, didn't rule on that issue. It sent the case back down to the trial court, not on the merits of the due process decision, but because it felt the lower court jumped the gun on addressing the constitutional question. The First Circuit did, however, walk through discussion points of reducing statutory damages versus limiting punitive damages.

GREATER DISCRETION FOR JUDGES?

One potential outcome in the Tenenbaum case is that a court will decide to rely on the model of punitive-damages style evaluation, giving judges greater discretion to reduce statutory damage awards in copyright cases. Unlike a common law reward reduction, the plaintiff would not have the immediate right to demand a new trial on damages. That would be a "significant change in the process," said John Chatowski, counsel at Nixon Peabody who specializes in intellectual property litigation.

The issue could also be resolved by the case of the other remaining individual downloader, Jammie Thomas-Rasset. That case is pending before the Eighth Circuit. To date, a jury has twice levied verdicts of over $1 million against Thomas-Rasset; the judge reduced the damages to $54,000 and the RIAA is appealing. Like Tenenbaum's case, Thomas-Rasset's case focuses on the fairness of these types of awards, and could beat Tenenbaum's to a decision.

Tenenbaum's options now are to appeal the First Circuit panel's decision to full First Circuit, to the Supreme Court, or to wait and see what happens when the case is sent back to the lower court. Tenenbaum's lawyer, Charles Nesson declined to comment for this story.

D.C. Metro files lawsuit against insurance company

WASHINGTON ? Metro has filed a lawsuit seeking more than $13 million from its insurance company, claiming that it has failed to pay costs and extra expenses in connection with the 2009 rail crash that killed nine people.

The lawsuit was filed last week in the U.S. District Court for the Eastern District of Virginia against Boston-based Lexington Insurance Co. A malfunctioning electronic circuit caused trains to crash near the Fort Totten station on June 22, 2009, on Metro?s Red Line, killing a train operator and eight passengers.

Metro claims that since the crash it has experienced a drastic drop in ridership and that transit agency property has still not returned to normal operations.

An after-hours call on Tuesday night from The Associated Press to Lexington Insurance was not immediately returned.

MIAMI ? Ozzie Guillen's website apparently leaked the news he has agreed to become manager of the Florida Marlins. A post Monday night quoted Guillen announcing he was Florida bound. The blog was taken down a short time later and replaced by a post that discussed Guillen's departure from the Chicago White Sox while making no mention of the Marlins.

Hours earlier, 80-year-old Marlins manager Jack McKeon said he would retire at the end of the season.

On Tuesday afternoon Guillen tweeted: "Weird to be in miami in this time but very happy ready to go".

His briefly posted blog said he had hoped to spend his entire managerial career with the White Sox.

"But there comes a point when you need to move on, and that point has come," Guillen was quoted as saying. "The Florida Marlins believe I am the right man for the job to bring another World Series to South Florida. ...

"I can't tell you how thrilled I am to be a part of the Marlins organization. I have an unbelievable amount of respect for the Marlins, owner Jeffrey Loria, president Larry Beinfest, and general manager Michael Hill. I can't thank them enough for this opportunity and look forward to the future. I can't wait to get started!"

After managing in Chicago on Monday, the outspoken, sometimes outrageous Guillen announced he was leaving the White Sox but said nothing about taking another job. Florida officials declined to comment.

The Marlins, who move into a new ballpark next spring, plan a big ceremony in conjunction with the final game at their current stadium Wednesday. There's speculation they want to cap the occasion by introducing Guillen as manager.

The buzz began more than a year ago that Guillen might be headed for the Marlins, where he was McKeon's third-base coach with the 2003 World Series champions. McKeon was coy Monday night about the possible hiring of Guillen.

"I like Ozzie," McKeon said. "I think he's a very, very intelligent manager. He was a smart player. He's a good man. I like him."

With a smile, McKeon added, "I'm going to have to like him, right?"

Guillen worked for Loria as the Marlins' third base coach in 2002-03. After they won the World Series, Guillen became the White Sox manager that November.

The Marlins are staggering to a last-place finish in the NL East. With the team moving to a new home and making a push to become a contender, Loria has said he wants an experienced manager.

Guillen would be the Marlins' fourth manager since early 2010, and his relationship with management could create some off-the-field excitement. Strong-willed Joe Girardi lasted only one season with Florida in 2006, clashed with Loria and others in the organization, and was fired shortly before being chosen NL manager of the year.

Guillen's quest for a new deal with the White Sox was denied, so he asked to be released from his contract, and that request was granted. With that, his eight-year run that included a World Series title in 2005 was over.

The White Sox said they retain the right to compensation should Guillen accept a managerial position with another major league team for the 2012 season. Guillen had a 678-617 record with the White Sox.

Guillen is the only manager in franchise history to lead the White Sox to more than one division or league title. Chicago also made the playoffs under Guillen in 2008, but they will finish under .500 this season.

Researchers discover gene that is mutated in some blood cancers and predicts better survival

ScienceDaily (Sep. 26, 2011) ? Geneticists have discovered that a gene involved in the modification of ribonucleic acid (RNA) is mutated in a significant proportion of people with a collection of blood cancers called myelodysplastic syndromes (MDS). The researchers found that mutations in the SF3B1 gene tended to be associated with a better prognosis, raising the possibility that patients could be screened for the mutation and their treatment tailored accordingly.

Dr. Elli Papaemmanuil told the 2011 European Multidisciplinary Cancer Congress that she and her colleagues found mutations of the SF3B1 gene in 20.3% of MDS patients and that it was closely associated with a particular feature of MDS called ring sideroblasts, which are found in bone marrow. "This is the first time that a close relationship between a mutated gene in MDS and specific feature of the disease has been detected. Mutations were found in about two-thirds (64.6%) of patients whose disease was defined by the presence of ring sideroblasts," says Dr. Papaemmanuil, who is a postdoctoral research fellow working at the Cancer Genome Project at the Wellcome Trust Genome Centre (Cambridge, UK) under the leadership of Dr. Peter Campbell.

"Further analysis showed that patients with the SF3B1 mutation had significantly better overall survival and leukemia-free survival compared to those without the mutation. This suggests that the SF3B1 mutations drive a benign form of MDS. As these mutations can be detected easily in blood samples taken from patients, it may be feasible to identify a group of MDS patients with a benign prognosis who could receive less aggressive treatment -- without recourse to an invasive bone marrow biopsy to look for the presence of ring sideroblasts."

Dr. Papaemmanuil's presentation to the congress coincides with the simultaneous publication of a paper about the research in the New England Journal of Medicine.

MDS are a diverse group of chronic malignancies of the blood. MDS patients often develop severe anemia and require frequent blood transfusions. Their blood cell counts can fall due to progressive bone marrow failure, and, for a subset of patients with MDS, their disease can progress into acute myelogenous leukemia (AML). MDS occur mostly in people aged 60 and over, and, as more people live longer, these syndromes have become the most prevalent myeloid cancer, with an incidence of around 20 cases per 100,000 of the population in the over-70s. Although several genes have been identified as mutated in MDS, all but one are mutated in only 5-15% of cases, and usually at a lower rate in the more benign subtypes of the disease.

Dr. Papaemmanuil and her colleagues used high throughput sequencing technology, also dubbed "massively parallel sequencing," to scan the genomes of nine MDS patients. Massively parallel sequencing enables researchers to work out the sequence order of the components of DNA (four nucleotides: A, C, G and T) in genetic material from the tumour. The purpose of this is to identify any somatically acquired mutations -- alterations in the DNA that have occurred after birth in the cancer cells that may be responsible for driving the malignancy.

They identified mutations in SF3B1, a gene that encodes a core component of RNA splicing machinery. RNA splicing is an important editing mechanism that controls the final sequence content of transcribed genetic material. To define the prevalence of the mutation, the researchers undertook targeted sequencing of the gene in 2,087 samples from patients with a range of myeloid and other common cancers (the samples were from blood, bone marrow or primary tumour cells). Somatic mutations of SF3B1 were found in 20.3% of patients with MDS, 5.3% of patients with AML and 2.9% in patients with myeloproliferative neoplasms (a related group of blood disorders). Interestingly, mutations in the same gene were also found in 1-5% of a range of other common cancers such as breast cancer, multiple myeloma and kidney cancer.

Dr. Papaemmanuil found a close relationship between the mutated gene and the presence of ring sideroblasts in the bone marrow; significant numbers of ring sideroblasts are found in over a quarter of MDS patients. Ringed sideroblasts are abnormal precursors to mature red blood cells, with a partial or complete ring of iron-laden mitochondria (energy generators) surrounding the nucleus of the cell. Their presence causes anemia because the body has iron available but is unable to incorporate it into haemoglobin, which red blood cells need to transport oxygen efficiently. Anemia is one of the symptoms of MDS.

"The close association between SF3B1 mutation and ring sideroblasts that we saw in these MDS patients is consistent with a causal relationship, and makes this the first gene to be strongly associated with a specific feature of MDS," said Dr. Papaemmanuil.

Data on how the patients fared were available for 123 of the MDS patients, of whom 34 had the SF3B1 mutation. The researchers found that patients with the mutation had a milder form of the disease, had significantly better overall survival and were less likely to survive without the disease transforming into leukemia, compared with patients without the mutation.

Dr. Papaemmanuil concluded, "MDS diagnosis and accurate classification still remains challenging. The identification of SF3B1 and the continuous characterisation of the underlying molecular mechanisms of this disease will provide useful insights that can directly inform both the understanding and clinical management of this disease. Our next step is to study a larger cohort of patients with MDS for the presence of known mutations such as the ones we identified in SF3B1, but also to continue to search for additional novel genes that may be mutated in this disease. A larger study population will also prove to be an invaluable resource in helping us quantify the clinical correlates of each mutation or group of mutations with clinical course and outcome."

WASHINGTON ? Republican National Committee Chairman Reince Priebus says the GOP has a great field of presidential candidates but that there's still time for someone else to get in.

With some conservatives saying Texas Gov. Rick Perry has had a shaky debate performance, speculation about the future of the GOP race has returned to the possibility of more candidates.

There's been talk that New Jersey Gov. Chris Christie could still enter the race, although Christie has said he's not planning to. Former Alaska Gov. Sarah Palin has left open the possibility that she might run.

Priebus says it gets "harder and harder" for other candidates to get in as the caucuses in Iowa early next year get closer, but he says there's still time. He appeared Sunday on CBS' "Face the Nation."

'Lion King' chases off Brad Pitt to remain No. 1 (AP)

LOS ANGELES ? Brad Pitt was unable to put the cat out of first place at the weekend box office.

Walt Disney's "The Lion King" reissue was No. 1 for the second-straight weekend with $22.1 million, according to studio estimates Sunday. That puts it just ahead of Pitt's baseball drama "Moneyball," a Sony Pictures release that opened at No. 2 with $20.6 million.

Debuting closely behind at No. 3 was the Warner Bros. family film "Dolphin Tale" with $20.3 million. "Dolphin Tale" stars Harry Connick Jr., Ashley Judd and Morgan Freeman.

The 3-D reissue of 1994's "The Lion King" has taken in $61.7 million since opening the previous weekend to a much bigger audience than expected. That's on top of nearly $800 million worldwide the movie made in its original run and a 2002 re-release.

The film has done so well that Disney plans to leave it in theaters longer than the two-week run the studio initially planned as a prelude to its Blu-ray home-video debut Oct. 4, said Dave Hollis, Disney's head of distribution.

The studio has not yet decided how long or how widely the film would play theatrically after the Blu-ray release, Hollis said.

"Consumers I think will be happy to consume it in multiple ways for this kind of franchise, as they have for the last 17 years," Hollis said.

"The Lion King" held up well despite a rush of four new wide releases this weekend.

"Twilight" co-star Taylor Lautner's action tale "Abduction" opened at No. 4 with $11.2 million. The Lionsgate release casts Lautner as a teen hurtled into a world of espionage as he tries to uncover the mystery of his past.

Another action thriller, Open Road Films' "Killer Elite," debuted at No. 5 with $9.5 million. The movie stars Jason Statham, Robert De Niro and Clive Owen as special-ops assassins caught up in a global revenge scheme.

"Moneyball" stars Pitt as Oakland A's general manager Billy Beane, who shook up the baseball world when his tight budget forced him to look for new ways to scout players. Jonah Hill co-stars as an economist who helps turn the A's into a contender using statistical methods that identify undervalued athletes.

With good reviews and Academy Awards buzz for Pitt and his "Moneyball" teammates, Sony hopes the film will stick around in theaters well into the fall.

It was a solid start for a film that looked dead in the water after Sony benched a previous version of "Moneyball" just days before shooting was to start in 2009.

That incarnation would have been made by Pitt's pal Steven Soderbergh, who directed him in the "Ocean's Eleven" movies. But Sony pulled the plug in a squabble with Soderbergh over the script.

Soderbergh departed, but Pitt stuck with it, determined to bring Michael Lewis' best-seller "Moneyball: The Art of Winning an Unfair Game" to the screen.

Much of the book dealt with the number-crunching sabermetrics system Beane adopted. "It wasn't the easiest code to crack. You had this really great book, but to translate it wasn't necessarily the easiest thing," said Rory Bruer, Sony's head of distribution. "You really needed people who believed in it, like Brad, and writers who understood it, and a director to really make it something very visual and compelling for folks to see."

"Dolphin Tale" managed a solid start despite unexpected competition for family audiences from "The Lion King." Based on a true story, "Dolphin Tale" centers on a group of strangers who come together to save an injured dolphin.

"The Lion King," "Moneyball" and "Dolphin Tale" managed a rare feat for typically quiet September, all finishing above $20 million for the weekend.

Hollywood's overall revenues came in at $122 million, up 21 percent from the same weekend last year, when "Wall Street: Money Never Sleeps" led with $19 million, according to box-office tracker Hollywood.com.

"This is one of the strongest September weekends I've ever seen," said Hollywood.com analyst Paul Dergarabedian. "'Lion King' got people in the mood to go back to movies, especially the family audience, and look at the combination of that one and `Dolphin Tale.' It shows that family audiences are willing to go to the movies whether it's summer or fall."

Estimated ticket sales for Friday through Sunday at U.S. and Canadian theaters, according to Hollywood.com. Where available, latest international numbers are also included. Final domestic figures will be released Monday.

The Internet is buzzing with Wii supporters who remember the Nintendo games of their youth, and hope for a return to simple, fun games, although it seems unlikely that the battle will be won that easily.

Researchers are only beginning to decipher this cryptic language, but already it?s clear that whatever these graffiti have to say is going to be important. Such epigenetic modification may be at the root of many diseases, for example. Epigenetics links external experiences to the molecular machinery inside cells. Francis? book is intended as a guided tour of this mysterious new landscape.

Each chapter starts with an entertaining or intriguing example of how epigenetics affects human and animal biology and inheritance. It?s not often you find Jos? Canseco, mouse mothers, Dutch famine victims, sea urchins, identical twins and Tasmanian devils all in the same book, but you will here. Francis just manages to save his story from crossing into textbook territory by weaving these examples throughout the chapters.

It?s still early days for the science of epigenetics, and researchers keep discovering layer after layer of epigenetic wallpaper plastered over DNA. Francis hits the highlights here, but stay tuned for more installments in this fascinating new science.?
