This month, I have looked at what is involved when a person had a new personal injury claim. Hopefully, whether you call us or not, it will help with the questions that start off right after a claim:

Figure out who is at fault

Early investigation is vital to determine who is at fault. Witnesses need to be contacted and often early statements can make a difference as to what is documented and what is remembered. Skilled investigators can be vital to these claims.

Photographs can save the day

It is not unusual to find that early photographs go a long way to document injuries and to help with determining issues such as causation and fault. Defense attorneys will often try to ask about why photographs were taken so you know that they hate to see them. The reason is documentation.

Witnesses are important

Collisions happen fast and for a person who is injured, they have so many things going on at the scene. However, everything should be done to get the names and contact information of the people who show up at the scene. They can play vital roles in confirming what was going on and how the collision happened.

Don?t be afraid to ask why

It is not unusual to have clients arrive and ask to know things about why the collision happened. The defendant just lost their job, was on the way to a funeral, or some other life issue. That same defendant after talking to an insurance adjuster or defense attorney will often later say that they weren?t distracted and they have no idea why they just drove through that red light or stop sign. So asking can make a difference.

Call the police

It is not unusual to talk to new clients who will say the defendant didn?t want to call anyone so they took the insurance information and didn?t call anyone. Guess what the defense tries to make a big deal out of? So call the police and at least get the collision documented.

Get the contact information of the defendant

There are Minnesota cases that say that an uninsured motorist case cannot be made if the plaintiff could have gotten contact information from the defendant and didn?t. So if you are in a collision, make sure you get all the information you can from the defendant.

Get checked out medically

If you are in a collision, it?s worth getting checked out right away. You can get the peace of mind that you are ok and also protect yourself if you have another collision a short time later. We have seen too many times where the insurance companies have stressed a prior collision because there was no medical proof one way or the other. So it?s worth getting medically cleared.

Look around at the scene

There is often all sorts of evidence that can be found at the scene after a collision. Pictures of skid marks or debris that is left behind can be important. We had one case where empty beer cans had been thrown out of the defendant?s car. So see what is out there, or if you are hurt, have someone do it for you.

Ask about who is in the defendants car

It?s not unusual to find out that people who are there don?t want to be known or may not be supposed to be there. It may be the reason why the driver was distracted or had other issues going on. This is early information that may never be found out if no one asks that day.

Make sure you look at your whole car

Insurance companies love to take photos of the outside without looking underneath the bumper or at all of the car. So it?s worth to check the trunk, look at trunk spacing, and always check underneath the vehicle. Those can be photos that explain a lot about the impact.

Think before you give a recorded statement

Remember that the adjusters know why they are asking certain questions. They call you week after week to wear you down and to get statements that mean things different than reality. It is these kinds of statements that are used to say you are at fault or that you aren?t really hurt. It helps to have legal representation on your side before you give that statement.

Think before you sign anything

Remember that the adjusters aren?t on your side. They often are in the business to minimize liability and the cost to their company. They call you week after week to wear you down and to get you to sign off on the claims. It helps to have legal representation on your side to see what it is that you are signing.

Get legal advice from a personal injury lawyer

(AP) ? Swiss banking giant UBS AG is to cut as many as 10,000 employees, or some 15 percent of its staff, to drastically shrink its ailing investment bank.

The news of the layoffs came as Switzerland's biggest bank posted another big loss for the third quarter. It said Tuesday that the job cuts are part of a strategy to shore up profits.

As a result, UBS said it needs to reduce its headcount to "around 54,000" by 2015, down from its current 64,000 employees in 57 countries.

Some 7,500 jobs are to be cut mainly in London and the United States, where UBS has a prominent building and trading operations in Stamford, Conn., near New York City. The other 2,500 cuts are to be in Switzerland.

Investors cheered the move and the stock was trading 6 percent higher in early trading in Zurich at 13.88 Swiss francs.

The announcement of the job cuts came as the Zurich-based bank posted a loss of 2.17 billion Swiss francs ($2.31 billion) in the third quarter, in contrast to last year' equivalent net profit of 1.02 billion Swiss francs.

UBS blamed the loss on a 3.1 billion francs charge at the investment bank and an 863 million francs hit linked to an accounting rule on how banks must value their debt.

Banks can post gains if the value of their debt falls, because it would theoretically become cheaper for the bank to repurchase that debt. But the rule also says that when a bank's debt increases, it must take a write-down because it would theoretically have to pay more to buy back its own debt on the open market.

In what it called "a significant acceleration" in its transformation, the bank said it would sharpen its focus on the investment bank and appoint a new executive, Andrea Orcel, formerly of Bank of America Corp., to lead it. The current co-head of the investment bank, Carsten Kengeter, is stepping down from the group's executive board to unwind the non-core assets.

UBS said it also plans to save 3.4 billion francs in additional costs through 2015, but that the reorganization will result in restructuring charges of 3.3 billion francs over the next three years including about a half-billion francs in the fourth quarter.

UBS CEO Sergio Ermotti said the investment unit, which has been hit by a series of costly blunders in recent years, will "continue to be a significant global player in its core businesses."

But tighter industry-wide requirements for banks to increase their capital cushion also have hurt profitability as banks have less cash to invest.

"It can't get better than this point for us to act," he told reporters.

Ermotti, who took over in November after the discovery of unauthorized trading last year, has been downsizing the investment bank to meet stricter capital requirements and shrinking profits due largely to Europe's sovereign debt crisis.

Former UBS trader Kweku Adoboli has been facing trial in London this month on charges of committing fraud that cost the bank $2.3 billion. He has told the jury that the losses came after senior traders persuaded him to change from a bearish to a bullish point of view in July 2011.

But the bank also has been under fire on other fronts. In 2008, it was forced to seek a bailout from the Swiss government when it was hard hit by the financial crisis and its fixed-income unit had more than $50 billion in losses.

UBS is one of several global banks being investigated in the U.S. and other countries for alleged rigging of benchmark interest rates known as Libor, or London Interbank Offered Rate. In April, Ermotti said Switzerland's tax disputes with the United States and some European nations are "an economic war" putting 20,000 jobs at risk.

Switzerland has been trying to shed its image as a tax haven, signing deals with the United States, Germany and Britain to provide greater assistance to foreign tax authorities seeking information on their citizens' accounts in the Alpine nation.

But the tax agreements have drawn fire from Switzerland's nationalist People's Party, which won more than a quarter of the vote in last year's general election, with some lawmakers saying they will try to block the treaties through referendums.

Insights into new therapy for rare form of cystic fibrosis

ScienceDaily (Oct. 29, 2012) ? Scientists at the Hospital for Sick Children in Toronto have established that a drug recently approved by the U.S. Food and Drug Administration to treat a rare form of cystic fibrosis works in an unconventional way. Their results reveal new possibilities for treating various forms of cystic fibrosis.

Cystic fibrosis is an inherited disease afflicting about 70,000 people around the world. Cystic fibrosis patients carry a defective gene that disables or destroys its protein product, which normally regulates the transport of ions across cell borders. When that transport is disrupted, the viscosity of the mucus coating certain organs becomes too thick. A characteristic feature of the disease is thick mucus buildup in the air passages, which causes difficulty breathing and recurring infections.

While the FDA approved the drug VX-770 (also known by the trade names Kalydeco and Ivacaftor) to ease breathing in people with cystic fibrosis caused by a particular mutation in the CFTR protein (the acronym is short for cystic fibrosis transmembrane conductance regulator), exactly how VX-770 worked in those patients was unknown.

Scientists have understood for some time that normal CFTR regulation requires modification of the protein and binding of a small, energy-providing molecule -- adenosine triphosphate, or ATP. But, in their recent Journal of Biological Chemistry "Paper of the Week," Christine Bear and colleagues report that the drug opens both normal and mutant CFTR channels without ATP. Their results indicate that the compound binds to a different site on CTFR than ATP. Significantly, this finding may be useful in developing therapies for cystic fibrosis caused by various CFTR mutations that, like the G551D mutation that was studied, impair ATP-mediated channel regulation.

Bear's group determined how VX-770 works after developing a new experimental system that may have potential for discovering drugs that target the basic defects caused by CFTR mutations, Bear says. The system is useful for identifying compounds that interact with rare mutations such as G551D as well as the major CFTR mutant F508del, she said.

(AP) ? A magnitude 7.7 earthquake struck off the west coast of Canada, but there were no reports of major damage. Residents in parts of British Columbia were evacuated, but the province appeared to escape the biggest quake in Canada since 1949 largely unscathed.

The U.S. Geological Survey said the powerful temblor hit the Queen Charlotte Islands just after 8 p.m. local time Saturday at a depth of about 3 miles (5 kilometers) and was centered 96 miles (155 kilometers) south of Masset, British Columbia. It was felt across a wide area in British Columbia, both on its Pacific islands and on the mainland.

"It looks like the damage and the risk are at a very low level," said Shirley Bond, British Columbia's minister responsible for emergency management said. "We're certainly grateful."

The Pacific Tsunami Warning Center lifted its tsunami advisory for Hawaii Sunday morning just before 4 a.m. local time, three hours after downgrading from a warning and less than six hours after the waves first hit the islands.

Meanwhile, the National Weather Service canceled tsunami advisories for Canada, Alaska, Washington, Oregon and California.

Tsunami Warning Center officials said wave heights were diminishing in Hawaii, though swimmers and boaters should be careful of strong or unusual currents. The biggest waves ? about 5 feet (1.5 meters)high ? appeared to hit Maui.

There were no immediate reports of damage, though one person died in a fatal crash near a road that was closed because of the threat near Oahu's north shore.

Hawaii Gov. Neil Abercrombie said the state was lucky to avoid more severe surges.

"We're very, very grateful that we can go home tonight counting our blessings," Abercrombie said.

Dennis Sinnott of the Canadian Institute of Ocean Science said a 69-centimeter (27 inch) wave was recorded off Langara Island on the northeast tip of Haida Gwaii, formerly called the Queen Charlotte Islands. The islands are home to about 5,000 people, many of them members of the Haida aboriginal group. Another 55 centimeter (21 inch) wave hit Winter Harbour on the northeast coast of Vancouver Island.

Canada's largest earthquake since 1700 was an 8.1 magnitude quake on August 22, 1949 off the coast of British Columbia, according to the Canadian government's Natural Resources website. It occurred on the Queen Charlotte Fault in what the department called Canada's equivalent of the San Andreas Fault ? the boundary between the Pacific and North American plates that runs underwater along the west coast of the Haida Gwaii.

In 1970 a 7.4 magnitude quake struck south of the Haida Gwaii.

The USGS said the temblor shook the waters around British Columbia and was followed by a 5.8 magnitude aftershock after several minutes. Several other aftershocks were reported.

The quake struck 25 miles (40 kilometers) south of Sandspit, British Columbia, on the Haida Gwaii archipelago. People in coastal areas were advised to move to higher ground.

Urs Thomas, operator of the Golden Spruce hotel in Port Clements said there was no warning before everything began moving inside and outside the hotel. He said it lasted about three minutes.

"It was a pretty good shock," Thomas, 59, said. "I looked at my boat outside. It was rocking. Everything was moving. My truck was moving."

After the initial jolt, Thomas began to check the hotel.

"The fixtures and everything were still swinging," he said. "I had some picture frames coming down."

Lenore Lawrence, a resident of Queen Charlotte City on the Haida Gwaii, said the quake was "definitely scary," adding she wondered if "this could be the big one." She said the shaking lasted more than a minute. While several things fell off her mantle and broke, she said damage in her home was minimal.

Many on the B.C. mainland said the same.

"I was sitting at my desk on my computer and everything just started to move. It was maybe 20 seconds," said Joan Girbav, manager of Pacific Inn in Prince Rupert, British Columbia. "It's very scary. I've lived here all my life and I've never felt that."

Residents rushed out of their homes in Tofino, British Columbia on Vancouver Island when the tsunami sirens sounded, but they were allowed to return about two hours after the quake.

In Hawaii, the tsunami warning spurred residents to stock up on essentials at gas stations and grocery stores and sent tourists in beachside hotels to higher floors in their buildings. Bus service into Waikiki was cut off an hour before the first waves, and police in downtown Honolulu shut down a Halloween block party. In Kauai, three schools used as evacuation centers quickly filled to capacity.

In Alaska, the wave or surge was recorded at 4 inches (10 centimeters), much smaller than forecast, said Jeremy Zidek, a spokesman for the Alaska Department of Homeland Security and Emergency Management. The first wave hit Craig about two hours after the earthquake.

Who is Bloody Face? That?s the question that?s preoccupying many around the Web this morning, following last evening?s exposition-heavy episode of American Horror Story: Asylum. The conventional wisdom?which Abby and I shared in our chat?is that we?re meant to believe its Dr. Arden, given his demonstrated interest in bondage and forced power-play with prostitutes, but that it?s actually probably someone else. After all, Arden?s already pretty old in 1964, so for him to hang around long enough to stab Adam Levine (good riddance) in 2012 would require some truly miraculous feats of science. Jen Chaney over at the Washington Post has floated the intriguing notion that perhaps our skin-masked killer is none other than the good Monsignor, who, as we learned over he and Sister Jude?s dinner of Julia Child?s coq au vin in Episode 1, possesses a hunger for power as well as perfectly browned mushrooms. I?ll definitely be keeping an eye on him in future episodes.

Reviewers are also really keying in to how much of this show?s tension comes from the guilt-complex inherent to certain brand of Catholicism. This episode saw a gauzy flash-back to Sister Jude?s years of ? indiscretion, a moment which led Sister Chaney to the following analysis: ?Sister Jude is, herself, a sinner, as worthy of having her head shaved as Shelley the Nymphomaniac. So when she?s punishing her charges, really, she?s punishing herself.? That hits the nail on the head, or is it the patient on the ass?

Speaking of bare bottoms, if you?re wondering how awkward it was to film all those scenes of chastisement, check out this ? revealing ? interview with actor Evan Peters in Vulture. Sounds like the cast of American Horror Story has to get comfortable with one another?s dark secrets pretty quickly on set.

Quitting Smoking Lengthens Women's Lives

Women who stop smoking before middle-age live about 10 years longer than women who continue to smoke throughout life, a new study from the United Kingdom finds.

Smoking until middle age does reduce lifespan somewhat ? women in the study who smoked until age 40 were about 1.2 times more likely to die over a 12-year period, compared with those who never smoked.

However, those who smoked their whole lives were nearly three times more likely to die over that same time period, compared with those who never smoked.

In other words, women who stopped smoking by age 40 were able to avoid about 90 percent of their excess risk of dying from smoking, the researchers said. And those who stopped smoking by age 30 avoided 97 percent of this risk.

The findings of the study ? which involved more than 1 million women born in the 1940s ?are similar to what has already been seen in studies of men.

"Women born around 1940 were the first generation in which many smoked substantial numbers of cigarettes throughout adult life," said study researcher Sir Richard Peto, of the University of Oxford. "Hence, only in the 21st century could we observe directly the full effects of prolonged smoking, and of prolonged cessation, on premature mortality among women," Peto said.

Participants were enrolled in the study around age 55, and were followed from 1996 to 2011. They completed a questionnaire about their lifestyle, medical and social factors, and were resurveyed three years later. During the 12-year study, about 66,000 participants died.

At the study's start, 20 percent of the participants were smokers, 28 percent were ex-smokers, and 52 percent had never smoked.

Those who were still smokers at three years after the study began were nearly three times more likely to die over the next nine years than those who did not smoke.

The excess mortality among smokers was mainly due to diseases that can be caused by smoking, such as lung cancer, the researchers said.

The study will be published tomorrow (Oct. 27) in the journal the Lancet.

Will Windows 8 crack the surface?

Firm sales numbers for Microsoft's Windows 8 and its new Surface tablet will not be available for three months, but it may be clear long before then if it has a hit on its hands.

"We can definitely gauge it by chatter," said Emily Chan, an analyst at Bernstein Research. "There is a slight learning curve, so I don't think we will see that big pop that iPad saw."

Microsoft is desperate for the new-look, touch-friendly Windows 8 to grip customers' imaginations, as it looks to regain ground lost to Apple and Google in mobile computing and shake up the moribund PC market.

Perhaps more important is its new own-brand tablet called the Surface, available only through its own stores and website, which will challenge Apple's iPad head on.

"I'd want to know the sales???and return rate???of the Surface," said Sarah Rotman Epps at tech research firm Forrester. "But those numbers will be hard to get since Microsoft is the only retailer."

Early reviews of the Surface have been mixed, generally praising the slick hardware, but faulting battery life and the limited software and applications available.

Some worry that the first Surface model, which runs on a stripped-down version of Windows 8 called RT that is not compatible with old Windows programs, will cause some confusion and dissatisfaction among customers.

The three models for sale on Microsoft's U.S. website are already on back order, suggesting strong demand, but it is not known how many Surfaces Microsoft has manufactured.

"The fact it's back ordered is indicative that there's consumer interest," said Michael Gartenberg, an analyst at tech research firm Gartner. "How Microsoft introduces it, evangelizes it and explains it will determine long term success."

Microsoft has not said if it will reveal sales figures for Windows 8 or of the Surface before its next scheduled earnings on Jan.?24. The company tends to trumpet good news and stay silent otherwise.

After the launch of Windows 7 three years ago, CEO Steve Ballmer waited only a month to announce strong sales. A year later, he waited only 10 days to report record-breaking sales of the Kinect, the motion-sensing add-on for the Xbox. But Microsoft has never shared the sales of Windows-powered phones, which have a lowly 3 percent of the market.

If Ballmer stays silent about Windows 8 sales, it might indicate a less than stellar performance.

"I would definitely take it a sign that it's not super, super strong, but I won't take it as something negative," said Chan at Bernstein, who is expecting 8.3 million Surface sales by the middle of next year.

That averages out at about 1 million a month, a third the rate of the iPad, which notched up its first million sales in 28 days and has now sold more than 100 million units, averaging about 3.2 million a month.

Gartner forecasts that Surface and other tablets running Windows RT will sell about 2.3 million units this year and 9.3 million next year, grabbing about 2 percent and 5 percent of the worldwide tablet market, respectively.

Door-busters

Retail activity will be closely watched. Microsoft will have more than 60 brick and mortar stores open for the release of Windows 8 on Friday, half of them 'pop-up' stores that will stay open for the holiday shopping season.

Third-party retailers are cautiously optimistic.

"We have seen pretty good response to our pre-orders for Windows 8," said Best Buy spokesman Jeff Haydock. "Quite honestly, I don't know what to expect from Friday. I don't know if there will be lines or not. My sense is it will take some time for people to kind of come into the stores and check it out."

Best Buy may give some color on how PC sales are going when it reports earnings on Nov. 20.

Wal-Mart Stores Inc, the No. 1 U.S. retailer, said U.S. pre-orders for Windows 8 PCs "have been better than expected."

Online retailers Amazon.com Inc, Newegg and TigerDirect have been silent on Windows 8 pre-orders.

The full impact of PC sales on retailers will not be evident until chains report same-store sales for November.

Quick reaction

One early indicator of Windows 8's success will be the contents of the online Windows Store. Microsoft has had a harder time drumming up interest among developers for Windows 8, given the risk that there will be fewer users than competing platforms.

Microsoft will not disclose numbers, but there are expected to be 5,000 or so third-party apps available to U.S. users, in comparison with the iPad's 275,000. Some big names such as Facebook will be missing.

In social media, the tenor of comments on the Twitter hashtags #Windows8 and #Surface will give an indication of their reception after Ballmer unveils them both on Thursday.

Many users likely will be shocked by the new design, which dispenses with the Start button and features square tiles for apps.

"Public reaction to the new UI will depend how well Microsoft explains why 'different' is better and teaches how the new experience works," said Gartenberg. "That all starts on Thursday."

By the numbers

The ultimate test for Windows 8 will be PC sales.

Industry trackers are expecting a bump for PC sales in the last two months of the year, but not enough to rescue the whole year, which is forecast to dip for the first time since 2001.

Some analysts had expected an uptick in production of laptops ahead of the Windows 8 launch, but PC makers facing an uncertain global economy have been wary about committing.

Chip maker Intel, which is a good gauge of future PC demand due to its position early in the production process, expects the PC business to grow at only half the normal seasonal rate in the fourth quarter.

Chief Executive Paul Otellini recently told analysts he expects to have a better understanding of the success of Windows 8 in 90 days.

Stephen Baker, an analyst at retail research firm NPD Group, is expecting a 10 percent jump in PC sales for November and December over last year, but said comparisons will be difficult given a profusion of new devices and the volatility of year-ago data.

Fourth-quarter PC shipment numbers from research firms Gartner and IDC will not be published until early January, although analysts say PC makers might start to drop hints about demand before then.

"There will likely be many milestones, but very few will ultimately be decisive. The key point is will PC sales continue to shrink or will they experience a boost," said Al Hilwa at research firm IDC. "We can probably begin to properly judge that with some ambiguity in January."

Big jump in young adults moving out of state

WASHINGTON (AP) ? Young adults are making big moves in the fledgling economic recovery, leaving college towns and parents' homes and heading out of state at the highest rate since the height of the housing boom.

New census data offer a detailed look at U.S. migration, which fell to a record low in early 2011.

The latest numbers show that adults ages 25-29 had the biggest gain in interstate migration in 13 years. They are striking out on their own to test the job market in such urban, high-tech meccas as Washington, D.C.; Denver; Portland, Ore.; Seattle; and Austin, Texas.

In contrast, groups that showed some of the most movement in the housing boom that peaked in 2005 ? working professionals, families and would-be retirees ? are still mostly locked in place.

Draghi enters lion's den to sell bond-buying plan

BERLIN (Reuters) - European Central Bank President Mario Draghi faces a two-hour grilling on Wednesday from German lawmakers who fear his bond-buying plan to ease the region's debt crisis could fuel inflation and undermine the ECB's cherished independence.

Unveiled in early September, Draghi's Outright Monetary Transactions (OMT) program is designed to prop up wobbling euro states such as Spain by reducing their borrowing costs.

It has already contributed to an easing of the euro zone's crippling three-year crisis, but German critics say it violates an ECB taboo on financing governments, taking the bank into dangerous new territory.

"What the ECB is doing at the moment has nothing to do with its mandate," said Klaus-Peter Willsch, a lawmaker from Angela Merkel's Christian Democrats (CDU), who will attend Draghi's closed-door appearance before members of the Finance, Budget and European affairs committees of the Bundestag.

"I want to hear from Mr. Draghi how he can reconcile unlimited bond purchases with the bank's price stability objective," said Willsch, a leading critic of Europe's bailouts.

Draghi is not the first ECB president to appear in Germany's lower house of parliament. His French predecessor Jean-Claude Trichet, along with former IMF chief Dominique Strauss-Kahn, briefed lawmakers in April 2010 on the details of the first financial bailout for Greece.

But the session, which will include 10-minute introductory remarks from Draghi followed by a lengthy Q&A and then short public statements from Draghi and Bundestag President Norbert Lammert, is a rarity.

The ECB was designed to be fully independent, and its president is not answerable to politicians. Wednesday's briefing is only taking place because Draghi offered to explain his policies in Berlin after they triggered uproar at the end of the summer.

His appearance underscores how important it is for him to keep politicians in Europe's biggest economy on-side amid the broader German backlash.

Jens Weidmann, the head of Germany's central bank, the Bundesbank, opposed his plan, as did Germany's conservative media. One ally of Merkel's dismissed Draghi as a "Falschmuenzer", or forger, after he went public with OMT.

UNANSWERED QUESTIONS

The exchanges are likely to be more polite on Wednesday. Merkel, many of her conservative allies and opposition parties like the Social Democrats (SPD) and Greens have voiced support for the Italian ECB chief's program, but there are still many unanswered questions he will be pressed on.

"Mr. Draghi has made clear that bond purchases can only take place under certain conditions," said Priska Hinz, a budget expert for the Greens. "We will want to know what kind of aid program and conditionality he sees as prerequisites."

This is crucial for Spain, which has resisted putting in a formal request for state aid, in part because of concerns it will be forced to put in place painful new economic reforms in exchange.

Many of Merkel's allies are resistant to a Spanish rescue because they fear it would trigger "unlimited" bond buys by Draghi's ECB.

"I expect the big questions to be about Spain," said Guntram Wolff, deputy director of the Brussels-based Bruegel think-tank and a former Bundesbank economist.

"There is a lot of opposition to a program for Spain. They are against it because they fear it would open the floodgates at the ECB. The concerns run very deep, also in the SPD."

Norbert Barthle, a budget expert for Merkel's CDU, said his colleagues were also likely to press Draghi about plans to give the ECB new responsibilities for supervising banks across Europe. Many lawmakers want assurances that this will not interfere with the bank's core monetary policy task.

But amid the concerns, there was general agreement that Draghi had done the right thing in offering to explain his policies at a time when many citizens in Europe feel momentous decisions are being taken without their input.

"One of the big problems of Europe is that European institutions only talk to voters through national governments," said Wolff. "So it's important to have a direct link to the people, and this is a step in that direction."

Hockey coach could face lifetime ban for punching 16-year-old player

A minor-hockey coach could face a lifetime ban after he punched a 16-year-old player from the opposing team during a game in this city on the weekend.

Violence broke out with about 10 seconds left in the match between two midget teams on Saturday.

The referee's report, obtained by QMI Agency, said a player from the Chicoutimi Cougars tried to jump over the bench of the Jonquiere Pumas.

An assistant coach tried to grab the player in question, before holding onto the teen's stick.

That's when the Pumas head coach came over and punched him in the head, the report said.

The coach of the player who was punched said his rival crossed the line.

"We're talking about a man in his forties doing something like that to a 16-year-old," said Cougars head coach Eric Gagne. "For me raising your hand to a player of that age is wrong."

Things degenerated when a Pumas player fell after being pushed by a linesman. The official was immediately tackled by other Pumas players, one of whom grabbed the linesman by the head before slamming into the ice.

"The official's visor was attached to his helmet with metal screws but after the match he had it in his hands," said Gagne.

Both Pumas coaches could be suspended for making contact with a player, according to the regional hockey association's rules.

The players who left the bench and attacked the linesman could also receive sanctions.

So far police are not involved in the case.

TI sales in 3Q beat estimates but 4Q outlook weak

DALLAS (AP) ? Chipmaker Texas Instruments Inc. said Monday that its third-quarter earnings rose 30 percent as it benefited from tax changes and a change in a Japanese pension program. Revenue fell slightly.

Net income in the three months to Sept. 30 rose to $784 million, or 67 cents per share, compared to $601 million, or 51 cents per share, a year ago.

The company's earnings benefited from tax and pension changes worth about 22 cents per share, but it booked 7 cents per share of charges for its acquisition of National Semiconductor and restructuring.

Revenue fell 2 percent to $3.39 billion from $3.47 billion a year ago. Analysts were expecting $3.34 billion in revenue.

CEO Rich Templeton said in a statement that the company executed well in the quarter "even though the economy and semiconductor market remained weak and likely will get weaker in the fourth quarter."

Texas Instruments said it expects fourth-quarter earnings of 23 cents to 31 cents per share. That's below the 36 cents per share expected by analysts. The company said it sees revenue in the final three months of the year at $2.83 billion to $3.07 billion, also below the average of $3.23 billion that analysts were looking for.

Shares fell a penny in after-hours trading to $27.78 following the release of results. Shares closed down 2 cents at $27.79 in the regular session.

A legal hitch may delay disqualification of Interior Minister Rehman Malik for making a false declaration about his dual nationality in 2008, as the Senate chairman did not receive reference from the apex court even after the lapse of one month, The Express Tribune has learnt.

The court had decided the dual-nationality case on September 20 and it was perceived that Malik would be disqualified after a 30-day period, the deadline given to the Senate for sending a reference to the Election Commission of Pakistan (ECP) against him.

The Senate chairman will have to determine within one month after the receipt of a reference from the apex court whether a disqualification has taken place or not ? this was clearly mentioned in the ruling, but that didn?t happen.

?? a reference will be required to be made to the chairman Senate under Article 63 (2) in view of the provision of Section 99 (1) (f) of the Act of 1976, which lays down that a person shall not be disqualified from being elected or chosen as a member of an assembly unless he is sagacious, righteous and non-profligate and honest and amen,? the court order stated.

The court observed that at the time of filing of nomination papers for Senate election in 2008, Malik made a false declaration that he was not a dual national and was thus not disqualified on that account.

In view of the false declaration, he cannot be considered sagacious, righteous, honest and ?amen? within the contemplation of Section 99(1)(f) of the Representation of People?s Act (RPA).

?The legal hitch might delay the process,? an ECP official told The Express Tribune without giving any timeframe for the completion of the process.

He referred to an ECP meeting scheduled for Monday with Chief Election Commissioner Justice (retd) Fakharuddin G Ebrahim and said the matter of Malik?s disqualification was not on the agenda.

Responding to a question, he said when there is a question about disqualification of a member that the speaker (of National or Provincial Assembly) or the Senate Chairman shall, unless he decides that no such question has arisen, refer the question to the ECP within 30 days and if he fails to do so within the stipulated period, it shall be deemed to have been referred to the ECP.

The ECP shall decide the question within 90 days from its receipt or deemed to have been received, and if it is of the opinion that the member has become disqualified, he shall cease to be so and his seat shall become vacant.

The ECP can act against Malik only after a disqualification reference is sent to it by the Senate chairman or getting clear directions from the SC as it was done in the case of former prime minister Yousaf Raza Gilani when the court had issued clear directions to de-notify him.
